Libraries should facilitate the reproduction of the works deposited, always in accordance with current legislation, particularly, articles 31.2 and 37 of R.D. 1/96 of 12 April, approving the revised text of the Intellectual Property Law.

Article 31.2 provides that the works already published may be reproduced for private use without the author’s permission, provided that the copy is not used collectively or for profit.

Article 37 provides that the owners of the copyright cannot oppose the reproduction of their works, provided that the copies are intended for non-profit museums, libraries…that are publicly owned or part of cultural or scientific institutions, and that the reproduction is intended solely for research purposes.

In the case of self-service photocopiers, the responsibility for the compliance lies with the user.
