Conference on Privacy, health and digital transformation: The Challenges of Big Data and Research, Valencia

Recent regulatory developments will have a significant impact on the compliance and security needs in the development of health research. In particular, data-intensive research and the results and processes based on it may be significantly concerned.

The most significant impact is likely to come with the full implementation of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/CE (General Data Protection Regulation).

This regulation incorporates provisions of particularly relevant significance for health research, such as pseudonymisation, a technique widely used in health research, and the issues raised by anonymisation, the protection of data by design and by default, data protection impact analysis.

In a context in which the reform of Organic Law 15/1999, of December 13th, on the Protection of Personal Data is being processed, and one year away from the full application of the General Data Protection Regulation it is essential to address the future of health research by identifying the opportunities offered by the new framework.

On the other hand, the implementation of the policy framework requires an understanding of research needs. And this understanding is bidirectional. If it is inescapable for research to integrate compliance conditions and ensure security, regulators cannot offer generic solutions sheltered from reality. It is therefore essential to find spaces for the shared construction of knowledge.
