ScienceFlows has joined the initiative coordinated by the Maldita Foundation in an open letter urging parliamentary groups to grant the CNMC the powers it needs to enforce the DSA in Spain.

The Digital Services Act, approved in October 2022 by the European Commission, aims to protect the fundamental rights of European citizens by acknowledging the enormous influence that large digital platforms and search engines can exert.

As set out in the EU Digital Services Regulation, national Digital Services Coordinators in each Member State are responsible for its enforcement. In Spain, this responsibility falls to the National Commission for Markets and Competition (CNMC). However, Parliament has not processed the necessary regulations for the CNMC to obtain the powers required to carry it out.

For this reason, more than 20 organisations and 40 researchers have joined together in an open letter calling for major platforms and search engines to comply with this regulation, which would oblige them to identify and mitigate the risks posed by their services. Among other consequences, the lack of implementation means that researchers and academics do not have the CNMC’s support to access key data from major platforms needed to study the risks arising from their design.
