The University of Valencia demands regulations that create safe environments for children in social networks in a paper published in ‘Nuevos conflictos sociales. El papel de la privacidad’, by the lecturers from the Faculty of Law Javier Boix, Ángeles Jareño and Paz Lloria.
The article is entitled “Menores, redes sociales e intimidad: consentimiento y tutela” (Children, social networks and privacy: consent and protection), written by lecturer in Criminal Law Paz Lloria, and stresses the importance of education so that new technological tools are integrated into the field of protection of minors in order to "avoid behaviours that seem socially tolerable but are constitutive of cybercrime".
According to Lloria, it is essential to establish "rules that oblige service providers of social networks to create a safe environment, by controlling illegal content, on the one hand, and by setting security policies for data and privacy, on the other hand", given that, according to the author, current rules "are still very far from that”.
Due to the increase of cybercrime, Paz Lloria argues that “legal actions must be taken to lodge complains through the network itself or through the professionals who are in contact with the child, such as the Tax Ministry, one role of which is to protect the interests of children". Still, the lecturer admits that these actions "do not fit in with the most logical economic interests of the companies that provide the services, which seem to put a premium on this area against the interests of the child".
For their part, lecturers Javier Boix and Ángeles Jareño, from the Department of Criminal Law, include in the same publication the issue of jurisprudential protection in cases of image recording with a hidden camera or without consent.
The book Nuevos Conflictos Sociales. El papel de la privacidad (New social conflicts. The role of privacy) has been coordinated by lecturers Enrique Anarte Borrallo, Fernando Moreno Moreno and Carmen Rocío García Ruiz. It has been published by Iustel in collaboration with the Government of Andalusia and the European Social Fund, and is the result of a research project with the same title, but involving also researchers from the projects Boundaries of the Legal Protection of Privacy and New Criminal Limits for Individual Autonomy and Privacy.
Paz Lloria García is a lecturer in Criminal Law and co-director of the Master’s Degree in Law and Gender Violence at the University of Valencia. She teaches undergraduate and postgraduate courses in Spanish universities and postgraduate courses at the National University of Mar del Plata (Argentina). She has worked teaching criminal law to local police forces, judges and prosecutors.
She has directed numerous pieces of research and is currently supervising several doctoral theses, two of which deal with the issue of violence against women in the family context regarding the use of ICT. She has also participated in research projects funded by the Ministry of Education and Science, the Ministry of Foreign Affairs (AECID), the Valencian Department of Education, the Andalusian Government and the University of Valencia.
