Legal Aspects on Genetic Medicine

At the present time when science is advancing at an unstoppable pace, the researcher must know the legal framework in which the research work must be carried out, specifically in the field of Genetics and its biotechnological applications (especially in those areas that affect human health).

This is because so-called genetic medicine, which uses a patient's genetic information for diagnosis, management and treatment decisions, is becoming increasingly important. Proof of this is the so-called gene therapy, the applications of genetics in health (genetic counselling, prenatal and pre-implantation genetic diagnosis, the selection of embryos, the use of predictive genetic tests in diseases, experimentation on stem cells...).

These activities are subjected to specific regulation, in Spanish Law 14/2007, of 3rd July, on Biomedical Research; Spanish Law 14/2006, of 26th May, on assisted human reproduction techniques; Spanish Royal Decree 1716/2011, of 18th November, establishing the basic requirements for the authorisation and operation of bio-banks for the purposes of biomedical research and the treatment of biological samples of human origin; Regulation (EU) No. 536/2014 of the European Parliament and of the Council of 16th April 2014 on clinical trials of medicinal products for human use; Organic Law 3/2018 of 5th December on the Protection of Personal Data and guarantee of digital rights. The latter regulates in its 17th additional provision the processing of health data for research purposes.

In this context, knowledge of the legal aspects of so-called genetic medicine is becoming increasingly important, both for health professionals, biomedical researchers, civil servants who deal with patient data...

The aim of the conference is to achieve synergies between traversal subjects of study by both scientific and legal researchers in order to provide data and conclusions and to contribute to the dissemination of the legal aspects of genetic medicine.  All within the framework of the Project I+D+I CONTRATOS, TRANSPARENCIA Y PROTECCION DE DATOS EN EL MERCADO DIGITAL (In English, R+D+I Contracts, Transparency and Data Protection in the Digital Market) (Ref. RTI2018-097354-B-I00) led by the Professors of Civil Law at the Universitat de València Javier Plaza Penadés y Luz M. Martínez Velencoso.

The activity will include the participation of both legal experts and health and research professionals specialising in these issues. It is aimed at professionals in the sector, as well as the research community and the public service interested in these aspects. The social agents and public administrations are also invited to participate in it, given the flexible structure that is programmed, that includes colloquium tables and debates.
