The author is professor of UV, arbitrator of the Court of Arbitration of Valencia and member of the research group MedArb, with this work aims to determine the relationships that can be established between hereditary partition and arbitration.
In addition, he wants to deepen the analysis of the extent to which recourse to arbitration can contribute to a more efficient resolution of inheritance conflicts.
Few matters present the level of conflict of inheritance litigation. The moment of division has always been revealed as one of the most delicate aspects and procedures designed by the Law of Civil Procedure (art. 782 and following ones LEC) to give a response about the inheritance conflicts that have never been characterised by their agility and efficiency.
