Quality indicators: The 275-page monograph, takes a theoretical approach to the fundamental tools of interpretation and integration of legal standards and key elements of legal arguments, starting with the major role played by the judge today (and not just the constitutional judge) in the new context of the constitutional rule of law, as the ultimate guarantor of the rights and freedoms of citizens, being subject to the principle of constitutionality, even above the traditional principle of legality. From this perspective (the enormous discretionary power of the judge) the new parameters are analysed from which the interpretive task and applicative law is to be performed (interpretation “of” and “from” the Constitution) and the indispensable requirement of justification (arguments) of judicial decisions. Beside the analysis of classical instruments and interpretive methods: the literal, historical and teleological interpretation of the rules, the integration mechanisms of the law are discussed in depth, especially the analogy legis (along with equity) and general principles of law, in its integrative function (considered as an analogy iuris). Finally, the field of legal argumentation is addressed by analysing the formal logical assumptions that should govern all rational argument, with argumentative criteria that justify a legal decision, concluding with an analysis of the theoretical tenets underlying theories the most relevant legal arguments. The monograph was published in Bolivia by the legal publisher m&a! acute;s important (El País) and is now in its third edition. It has become a scientific reference in order to approach to judicial task in the context of the new Bolivian Constitution State, from the new State Constitution of 2009. It also constitutes a mandatory reference in the Master’s Programme of Civil Law and Civil Procedural Law conducted by the Postgraduate Studies Unit of the “Gabriel René Moreno” Autonomous University of Santa Cruz de la Sierra, the most prestigious in the country. Quality indicators: The 275-page monograph, takes a theoretical approach to the fundamental tools of interpretation and integration of legal standards and key elements of legal arguments, starting with the major role played by the judge today (and not just the constitutional judge) in the new context of the constitutional rule of law, as the ultimate guarantor of the rights and freedoms of citizens, being subject to the principle of constitutionality, even above the traditional principle of legality. From this perspective (the enormous discretionary power of the judge) the new parameters are analysed from which the interpretive task and applicative law is to be performed (interpretation “of” and “from” the Constitution) and the indispensable requirement of justification (arguments) of judicial decisions. Beside the analysis of classical instruments and interpretive methods: the literal, historical and teleological interpretation of the rules, the integration mechanisms of the law are discussed in depth, especially the analogy legis (along with equity) and general principles of law, in its integrative function (considered as an analogy iuris). Finally, the field of legal argumentation is addressed by analysing the formal logical assumptions that should govern all rational argument, with argumentative criteria that justify a legal decision, concluding with an analysis of the theoretical tenets underlying theories the most relevant legal arguments. The monograph was published in Bolivia by the legal publisher m&a! acute;s important (El País) and is now in its third edition. It has become a scientific reference in order to approach to judicial task in the context of the new Bolivian Constitution State, from the new State Constitution of 2009. It also constitutes a mandatory reference in the Master’s Programme of Civil Law and Civil Procedural Law conducted by the Postgraduate Studies Unit of the “Gabriel René Moreno” Autonomous University of Santa Cruz de la Sierra, the most prestigious in the country.
