From social Justice to integrative Justice

The Faculty of Law hosted an International Congress to rethink the new concept of Justice of the 21st century, marked by Glocalisation in criminal Justice, causing effects such as the loss of state identity or less freedom and security.

‘Towards a new concept of integrative Justice’. Is the motto that inspired the International Congress celebrated by MedArb group last September at the Faculty of Law of the Universitat de València to rethink the Access to Civil and Criminal Justice

The event congregated international experts and speakers coming from European universities, such as Italian, German, Dutch and English ones, in addition to the collaboration of a large group of reputable specialists and professionals of the area of Justice.

The new contributions in the conception of Justice are no longer inspired by the paradigmatic model of the 20th century, linked to the public sphere and the State and vertebrate on citizens. This conception of state-based Justice that rests on the social conception of Access to Justice projected in the great social institutions, has changed due to a new global, changing, digital and liquid society and, above all, suffering of great inequalities. Within this changing framework, the MedArb Group of the UV works in the reformulation of the conception of Justice and opts for the concept of integrative Justice, which inspires this International Congress. Experts observed the new factors of the Justice of the 21st century, such as ICTs and new mediators and arbitrators, as well as the new scenarios in the area of criminal tutelage, which, according to them, present a society that has lost freedom and security. In fact, there is a judicial reality in the criminal area, which is now glocalised, increasingly supranational and with more controls and preventions, which causes a loss of national identity in each State.

The International Congress was held within the framework of the projects MINECO DER2013-44749-R (Mediation, arbitration and jurisdiction in the current Justice paradigm: integration, ‘glocalisation', Public Law and ODR as some of its challenges) and PROMETEO II 2014/081 (ADR and Justice: Globalisation or glocalisation?) and had a great reception and high confluence of the public. 

The conclusions drawn from the meeting will be published starting next year in a monograph that will incorporate the contributions of the speakers.
