
As part of the PROMETEO 2018/2011 Project, ‘Claves de Justicia Civil y Penal en la sociedad del miedo’, Montserrat de Hoyos Sancho, Professor of Procedural Law at the Universidad de Valladolid, has published in the Tirant lo Blanch publishing house the book “Efectos ad extra del derecho a la presunción de inocencia” (Ad extra effects of the Law on the presumption of innocence).
This monographic work analyses the main consequences of the effective enforcement of this fundamental right, from a theoretical and practical perspective, with the support of numerous Spanish and European jurisprudence. It is analysed beyond the strict scope of the criminal process, but in contexts directly linked to it, such as the right of the investigated/accused to receive a compensation after an acquittal or closure of the case, or to be treated by all the public authorities as not guilty, from the time the investigation is initiated and until, eventually, a final statement of condemnation is pronounced.
As part of the objectives of the mentioned PROMETEO Project, the author provides various keys of action, solutions and proposals regarding the possibilities of redress in the event of an infringement of this extra-procedural aspect of the fundamental law.
