Civil Justice

In January and February, the Winter Seminars “Claves de la Justicia Civil en el Siglo XXI: Eficiencia y Digitalización” have been taking place at the Universitat de Valencia. They were financed by the research groups DER 2016-74945-R (Psychoanalysis of arbitration: is it a solution or a problem to the current paradigm of Justice?) and PROMETEO 2018/111 (Keys for Civil and Criminal Justice in the Fear Society).

Different issues such as the consumer tutelage have been studied in different projects. It has counted on Professor M. José Catalán and Professor Carla Esplugues’s analysis of “Justicia Administrativa y Arbitraje”. In February, several essential and contemporary problems have been addressed, such as “Irrupción de las Class actions en el Arbitraje y en la Justicia Civil” with the collaboration of Professor Teresa Armenta. Another issue was the implementation of orality, a seminar which counted on the collaboration of the magistrate Isabel Tena Franco. Other two seminars were “Eficiencia y digitalización en dos instituciones procesales, como prueba y monitorio” of professor and magistrate Sergio González Malabia and “Tecnologías, Digitalización e Inteligencia Artificial en la Justicia Civil”, conducted by Professor Vicente Guzmán Fluja. The sessions demarcated some keys of the Civil Justice and Arbitration in Latin America, thanks to the collaboration of Joseph Campos (Peru), Hans Guthrie (Chile) and Juan Mendoza (Cuba).

The objective of these seminars was studying one basic fact: The Justice of the 21st century must change the way legal actions are managed and conflicts resolved. In this context, the seminars are focused in two opposite issues: the expansion and challenges of Arbitration and the digitalisation of Civil Justice. The world is full of complexities that affect the roots of Civil Justice. The intervention of experts enriches the panels of discussion and creates the proper environment for a legal think-tank.
