Suspension of the work contract due to pregnancy

1.- What is it?

It is a protected status for economic reasons contained in the Royal Decree 295/2009, in which the economic benefits of the Social Security system regarding the following topics are regulated: maternity, paternity, risk during pregnancy and risk during nursing, that consist of the work contract suspension due to risk during pregnancy. During that period, a 100% benefit of the regulatory base is recognised.

The Mutual Insurance Company for Occupational Accidents and Diseases of the Social Security is responsible for the recognition and payment of this situation.

2.- Who can apply?

Employees of the Universitat de València.

3.-When should it be requested?

When the risk assessment carried out by the technical and medical staff on the working conditions of the worker determines that there is an occupational risk and that it is not possible to adapt or change the employee’s job.

4.-What procedures are required?

4.1-Employees who are registered in the General Social Security Scheme.

STEP 1: Notification to the Mutual of Social Security on the occupational risk

With which the procedure starts and when the Mutual Society will value the existence of the risk or not during pregnancy.

The pregnant worker will submit in the UMIVALE Mutual the pertinent documentation related to the Licence for Risk During Pregnancy or Nursing. First step

The Environmental, Health and Safety Services help the pregnant worker to complete the documentation that has to be submitted.

 

STEP 2 Request for the economic benefit

It will only take place once the Mutual Society has recognised the existence of risk during pregnancy. In this step, the request for the economic benefit will be processed.

The pregnant worker must present in the Mutual Society the documentation that is specified in its website: Benefit for Risk During Pregnancy or nursing. Second step

To complete these forms you must contact with the Social Security Section of the Universitat de València (seccionss@uv.es) It will be necessary to present the certificate of the UMIVALE recognising the risk due to pregnancy.

4.2-Workers included in MUFACE

STEP 1. Benefit for risk during pregnancy or nursing

The pregnant worker will submit in the Human Resources PDI (teaching and research staff) Service the medical report of MUFACE for risk situations during pregnancy or nursing:

STEP 2: Request for the economic benefit

From day 91 in a risk situation during pregnancy, the subsidy can be requested to MUFACE
