The approach to the right to housing for older people, in view of the three described main ideas–housing and care, housing and poverty, and housing and the environment–, will be carried out using a legal and sociological methodology.
With regard to the legal analysis, the project aims to study the existing regulatory framework on housing at international, European, national, regional and local levels, as well as the existing references relating to older people and the contexts of vulnerability in which they may find themselves. In addition, the case law of different courts will be analysed, mainly of the European Court of Human Rights and the Constitutional Court, but also of the ordinary courts, in order to assess how the protection of the right to housing for older people is articulated, the emerging conflicts, and the balance of interests and rights carried out by the relevant court in the resolution of the different cases. Attention will also be paid to the doctrinal contributions currently being made on the right to housing in light of the recently approved national legislation. Furthermore, the Inter-American system for rights protection in relation to housing rights is also of interest, including both the case law of the Inter-American Court and Commission, and reparation measures within the framework of public policies aimed at the recognition of this right.
From a sociological perspective, the different existing databases at both national and regional levels that contain information on housing and households will be analysed, including those of the National Statistics Institute such as the Population and Housing Census, the Survey on Living Conditions and the Survey on Population and Housing Characteristics, as well as those produced by different ministries such as the National Health Survey and IMSERSO surveys. International sources with disaggregation by NUTS will also be analysed, including EU-SILC among others. In addition, taking into account the limitations of statistics that allow the disaggregation of information by age group, and with the aim of completing variables relating to vulnerability and risks associated with housing, as well as conducting contextual analysis, statistics produced by other organisations such as FOESSA will be considered, along with those provided by the statistical portal of the Generalitat Valenciana. The aim is to produce a diagnosis that is as faithful as possible to the social reality experienced by households of older people.
