Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th, 2016 , on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) has a significant impact on the field of research.
At the national level, the approval of Organic Law 3/2018 of December 5th on the Protection of Personal Data and Guarantee of Digital Rights has opened up new avenues for the processing of data for scientific and research purposes. Thus, its Seventeenth Additional Provision, on the processing of health data, has defined a new framework in Spain for biomedical research. This regulation incorporates provisions of particularly relevant significance for health research, such as pseudonymisation - a technique widely used in health research - and the issues raised by anonymisation, by the protection of personal data by design and by default, as well as by data protection impact analysis.
Proper implementation of the above-mentioned regulatory framework requires an understanding of research needs by all sectors involved, not only by researchers, but also by the managers of the research projects in which they are framed - and not only at national level, nor, of course, only by the public sector. And this understanding is bidirectional: if we want to achieve quality research, it is essential to integrate regulatory compliance, to comply with the mandatory requirements and, in the field of privacy, to guarantee, ultimately, the security of the information handled. But properly complying with data protection rules requires understanding the real needs of the environment they are intended to regulate and that they do not hinder scientific development. It is therefore essential to find spaces for the shared construction of knowledge.
Each of the sessions of the Conference aims to highlight the needs of each of the roles in the university research ecosystem and at the same time to identify the lines of interaction that allow the construction of a functional management model that guarantees the objective of data protection by design and by default.
