
The seminar took place on January 29th at the Chamber of Commerce, Industry and Navigation of Valencia, and was organized by Prof. Silvia Barona Vilar, principal investigator of the DER 2016-74945-r project (Psychoanalysis of Arbitration: solution or problem in the current paradigm of Justice).
The seminar provided an interesting meeting with arbitrators from various Arbitration and Mediation Courts and Latin American professionals who are studying the Master's Degree in Law, Business and Justice at the Universitat de València generating debates and putting on the table issues of complexity in current arbitration practice, issues that come together in daily life and from which discussion forums are being promoted to seek solutions to the development of arbitration in a framework of good arbitration practices and rules of behaviour that allow progress in the long history of arbitration as an alternative to jurisdictional.
Four experts in the field participated: Prof. Dr. Rafael Verdera Server, Professor of Civil Law at the Universitat de València, practising lawyer and arbitrator, who raised the issue of pathological agreements; Judge Mª Pía Calderón Cuadrado, from the High Court of Justice of the Valencian Community, Professor of Procedural Law in special services of the UV, who highlighted the difficulties encountered by the Supreme Court of Justice when making judicial appointments of arbitrators. José Francisco Etxeberría Guridi, Professor of Procedural Law at the University of the Basque Country, who incorporated a complicated debate on the possible criminal liability of arbitrators; and finally Prof. Dr. Francisco Blasco Gascó, Professor of Civil Law at the Universitat de València, Lawyer and Arbitrator, who shared his experience as an emergency arbitrator in the adoption of arbitration precautionary measures with those present, highlighting the shortcomings of the existing flexible model.
