The Order of 3 June, 1997, which establishes the minimum general requirements of training and specialisation to provide the free legal services, stated among other different requirements, such as to certify more than 3 years of effective practice of the profession, that of:
"To hold the diploma of the course of the School of Legal Practice or equivalent courses approved by the Bar Association, or have completed the courses or admission tests for in-court representation and legal assistance for the person under arrest by the Boards of Government of the Bar Association”.
Thus, the completion of the course of the School of Legal Practice was a prerequisite for the collegiate members to access to the in-court representation.
After the modification of the Regulations of the General Council of Spanish Lawyers, of Approval of Schools of Legal Practice, of 14 December 2012, it is permitted in its transitional provision that:
“The licenciados (Spanish former undergraduate degree) and graduates in Law who have completed their training courses or certified masters’ regarding to the effects of the Law 34/2006, can access the tests to obtain the Certificate of Professional Competence that refers to the First Transitional Provision of these Regulations, provided they have met the requirements established in the article 27.1 sections a and b of the Regulations of Approval of Schools of Legal Practice and practical introduction to law practice, approved by the CGAE on September of 2004, which they must certify providing the report referred in the Article 33 of the mentioned Regulation and for that purpose the address of the training course or Master's should be issued.
Consequently, the licenciados and graduates of Law who have followed the courses of the Schools of Legal Practice or the Master's Degree in Law Practice, will be equated to these effects.
Obviously, this doesn’t exclude the need to pass the CAP tests (Certificate for Professional Competence) or established equivalents set as access requirements. Simply, it means that students (whether licenciados or graduates) who have completed all the credits (including the Master’s degree final project) of the Master’s Degree could do such tests.
And, of course, law graduates are not exempt from taking the Master’s for the purpose of their affiliation, even if they have taken the courses of the School of Legal Practice.
