Joana Marabella, a final year student from the Degree in Law and graduated in Political and Public Administration Sciences by the University of Valencia, has won the third prize in the ‘Third Young Researcher Award’ by the Universidad Autónoma de Madrid, for her work ‘El nuevo delito de ciberacoso sexual a menores: su adecuación con los principios penales de legalidad y de ofensividad’ (‘The new crime of sexual cyberbullying to minor: its adaptation with the legal and offensive criminal principles’), a research directed by Professor Javier Boix and Professor Lucía Martínez, of the Faculty of Law at the University of Valencia.
“The objective of the research is to analyse to what extent new technologies and communication systems help the proliferation of sexual cyberbullying to minors or child grooming cases, to examine from the rational principle perspective in the elaboration of criminal laws if there is a real problematic that legitimizes the introduction of the 183.bis article that typifies this behaviour, as well as the tensions posed by this new incriminatory modality with criminal basic principles”, explains the researcher.
In this paper, Joana Marabella also deals with the study of the modifications that affect this penal kind in the Reforming Project of the Criminal Code, and to what extent these modifications remedy the deficiencies shown in the research, as well as the new problems that arise in relation with this offence.
The award won by Joana Marabella is the full publication of this research. The award, organised by the Revista Jurídica (Law Journal) of the Universidad Autónoma de Madrid, aims to promote scientific research among students of law and political disciplines and is addressed to all students registered in a Licenciatura (former Spanish undergraduate degree) or Grado (new Spanish undergraduate degree) in any faculty of Law and Political Sciences in Spain or abroad.
The first stage of the award consisted on the presentation of a proposal in which the lines of research were explained. The selected people went to the final, which took place in the building of Law, Political and Economic Sciences at the Universidad Autónoma past 29 November. The finalists performed an oral defence of the research before a jury formed by professors of Madrid academic institution.
