General terms and conditions

1. General information 

In compliance with the provisions of article 10 of Law 34/2002, of 11 July, on e-commerce and information society services (hereinafter, ECISSA), general information on the services offered is provided on the course website of the University of Valencia Language Centre (hereinafter, the UV Language Centre Course website).  

The University of Valencia Language Centre (hereinafter, the UV Language Centre Course website or owner of the website), is the entity that owns the course application and manages various courses, services and activities through the duty of management given by the University of Valencia.

2. Purpose and scope of action 

The Terms of Use and the Specific Terms and Conditions for each course regulate users' access to and use of the UV Language Centre Course website. By accepting these Terms of Use, the user declares:
 
That he/she has read and understands that which is set forth herein.

That he/she is a person with sufficient capacity to enter the contract.

That he/she assumes all the obligations set forth herein.

The use of the UV Language Centre course website and registration on the same creates the status of website user and implies the acceptance of all the provisions included in these Terms of Use, which will be available to users each time they access the UV Language Centre Course website. Therefore, the user must carefully read these Terms of Use.

The UV Language Centre, through the UV Language Centre course website, reserves the right to make any modifications or update the content and services of these Terms of Use and, in general, of all components that are included in the design and configuration of the website by notifying registered users. This will not affect the Specific Terms and Conditions of the courses already taken, for which the existing terms and conditions at the time of starting the course will be maintained.

3. Access and registration 

Access to the UV Language Centre course website is free of charge, except for the cost of connecting the user to the telecommunications network provided by the user's access provider.
 
In general, it will not be necessary for the user to register in order to access the website.
 
However, prior registration is required in order to enrol in a course at the UV Language Centre and implies the prior acceptance of these Terms of Use and the specific terms and conditions of each course, which will be made available before enrolment. The user will then receive an email to verify their identity and the registration will be completed successfully.

The registered user can access his/her private area with his/her email address and password in order to check and update his/her profile, enrol in courses, check his/her status or unsubscribe.

The data provided by the user will be processed by the UV Language Centre in accordance with the provisions of the Privacy Policy available on the UV Language Centre website.

4. Users 

The data entered by the user must be accurate, current and true at all times. Providing false data and in particular providing a false identity will be considered a violation of these Terms of Use, and may result in the immediate blocking of the user's account and the claim for any damages that the inaccuracy of said data may have caused. Under no circumstances may the user register another person without proper authorisation.

The registered user will be responsible, at all times, for protecting his/her password, and thus accepts any damages arising from its improper use, transfer, disclosure or loss. To this end, access to the private area of the UV Language Centre course website using the password of a registered user shall be deemed to have been carried out by the said registered user, who will be responsible in any event for the said access and use.

Pursuant to the above, the user is obliged to immediately notify the UV  Language Centre of any event that enables the improper use of the password, such as theft, loss, or unauthorised access, in order to proceed with immediate cancellation. 

If such events are not reported, the UV Language Centre shall not be held responsible for any events that may arise from the improper use of the password by unauthorised third parties.

5. Registration and enrolment process 

To register for and enrol in a course, the user must enter their private area and select the course he/she wishes to take. He/she will be able to check the summary, course programme and specific terms and conditions of the course.

Access to non-beginner groups for new students is subject to the completion of a free level test, available on the Language Centre's website, with the exception of Valencian courses. This level test will not be necessary for students who can show proof of being in possession of a level certificate from any of those listed in the table of equivalences for the accreditation of languages approved by the Governing Council of the University of Valencia: https://www.uv.es/sgeneral/Reglamentacio/Doc/Estudis/C81.pdf

"ENROLL": once the course has been selected, the user must complete the information required on the next screen. Next, the user must read and accept the general terms and conditions of the courses of the UV Language Centre, the specific terms and conditions of the course and the course Privacy Policy in order to accept registration on the course and complete the billing information if it is in a company name.

After the registration process described above, the user will receive an email with the subject: "registered on course".  It will be necessary to proceed to course payment to complete the enrolment process. Enrolment will not be completed until payment is made and, therefore, no place will be reserved. 

Once payment has been made, the UV Language Centre will send an email to the user with the subject: "Successful enrolment" with a link to the summary page of the course enrolled in. Once the fee has been paid, the user will be considered to be enrolled for all purposes.

In some courses there will be different prices depending on the group to which the student belongs. The UV Language Centre will confirm that the student belongs to the selected group by validating the documents provided during registration and/or requesting the accrediting documentation from other groups.

The user will then be able to check the status of their enrolment in the private area. Once payment has been confirmed, the status will be "Enrolled", indicating the date of registration and the option to exercise withdrawal, a procedure described in points 8 and 13 of these terms.

Waiting list: When a course is complete and the waiting list has been opened, users who wish to do so will be able to join the waiting list. If places are available, they will be offered to those on the waiting list in order of registration.

The user will receive an email with a link that will enable them to access the course application. The interested person will have to complete the registration form following the usual procedure.

6. Course price and payment 

The course price will be that which is indicated in the course description at the time of registration. In addition, special prices will be duly indicated in the course description. 

Payment must be made by card as described in the previous point.

7. Course cancellation 

Carrying out courses is subject to the enrolment of the minimum number of students set for each course. If the number of students does not reach the minimum number set, the course may be cancelled. Likewise, the group may be divided or cancelled at the management's discretion depending on the needs of the centre. This situation will be made known to those affected, who will receive information about other available groups or, where appropriate, a full refund.

Cancellation of a course entitles enrolled students to request a refund of the enrolment fee or transfer to another course at the Language Centre of an equal, lower or higher amount (with the difference in price to be paid by the user or the Language Centre) within the same academic year, as long as there are vacant places and the requirements of the new course are met. 

Reasons for cancellation are as follows: 
a) Cancellation of a course due to not reaching the minimum number of students. 
b) Administrative error. 
c) Due to force majeure

d) Change of time and/or date by the teaching staff. 

8. Cancellation and withdrawals

Regardless of the right of withdrawal in section 13 of these conditions, a refund of the amount paid as course fees may be requested according to the indications set out below, unless other conditions specific to the course enrolled in are established in the document. The request must be sent by email to the Secretary's Office of the Language Centre of the UV: contactocdi@uv.es

In general, it is established that:

  1. If enrolment in the course is cancelled at least fifteen calendar days before the start date of the course and due to any of the following justified reasons: change of schedule of the UV academic year that prevents class attendance, starting a new job, change of working hours, long-term illness, moving to another city, visa denial or other force majeure, students will be entitled to a full refund of the amount paid, except for the registration fees, which in no case are refundable. The correct documentation to support these reasons must be provided by students.
  2. If enrolment the course is cancelled at least fifteen calendar days before the start date of the course due to other causes not included in the previous section (a), students will be entitled to a refund of 50% of the cost of the course paid, except for registration fees, which in no case are refundable.

No refund shall be given after the periods set out above. It is compulsory to process the enrolment cancellation and refund request by sending an email to  contactocdi@uv.es. The date of the request will be understood to be the date of sending the email, for the purpose of calculating the periods that may result in a refund of the amount paid being given. 

If the resolution is favourable, the corresponding amount will be refunded. 

If the resolution is not favourable, no refund will be given, even if the student stops attending the course. 
In the event that the refund involves additional expenses or bank fees, these will be payable by the student.

9. Obtaining certificates 

To obtain a certificate of attendance and/or achievement for the course, the interested person must be enrolled and have met the minimum requirements specified for each course.

Course certificates will be available to students who have passed the course within fifteen calendar days following the end of the course. In each course, students will be informed of how to obtain their certificates.

10. The University of Valencia’s virtual classroom or Google Classroom and intellectual property of materials 

Registration for Language Centre courses implies the possible use of the University of Valencia's VIRTUAL CLASSROOM application (UV VIRTUAL CLASSROOM) or (as well as those indicated in the specific Terms and Conditions) for course management (making materials and documents available, forums, chats, sending emails, calendar, etc.).

The materials that are made available to users are protected by copyright, and their reproduction and public communication has been carried out for a single and exclusive teaching purpose and for the individual use of the students on the course. Any reproduction, distribution, transformation and public communication in any medium and in any form outside the said scope is prohibited. Failure to comply with the foregoing will create liability for anyone who fails to comply. 

11. Confidentiality 

All materials, videos, techniques, data of classmates, etc., that are shared with users are strictly confidential, and are provided for a single teaching purpose. Therefore, they may not be used by persons other than those indicated or for a different purpose, being totally prohibited their dissemination through any channel and making them available to the public.

In addition, it is forbidden to record classes, tutorials, video calls, etc., record and/or broadcast them through any channel, without the authorisation of all those involved.

12. Specific course terms and conditions 

The specific terms and conditions of courses offered by the Language Centre will include at least the following:

  • Introduction to the area/service: Technical information of the course: programme, objectives, methodology, teaching staff, minimum requirements 
  • Duration and place.
  • Price.
  • Method: in-person/online: and which application will be used: the UV virtual classroom. 
  • Image rights: whether the sessions will be recorded and for which purpose
  • Information on the exceptional situation of the pandemic
  • Contact: email
  • Access to General Course Terms and Conditions
  • Access to Course Privacy Policies

13. Terms and Conditions of the right of withdrawal from 

IN-PERSON and SEMI-ONLINE COURSES: 
 

Before the start of the course, and without the need to indicate the reason, the user may exercise the right to withdraw from the contract within 14 calendar days from the date of formalising their enrolment, understood to be the date of confirmation by email that enrolment has been carried out correctly.

In the event that the right of withdrawal is exercised once the course has begun, but within a period of 14 calendar days from the date when enrolment was formalised, the amount paid will be refunded, discounting the proportional amount corresponding to the part of the course taken from the beginning until the date of notifying withdrawal.

ONLINE courses: 
 
In online courses, the user may exercise the right of withdrawal within 14 calendar days from the date of enrolment, as long as the course has not begun. The General Law for the Defence of Consumers and Users (LGDCU) has stated in Article 103.m (exceptions to the right of withdrawal): "The supply of digital content that is not provided on a material medium when the performance has begun with the prior express consent of the consumer and user with the knowledge that, as a result, he loses his right of withdrawal".

The course begins on the date scheduled to provide access to the course content available through the computer application used in each course (UV virtual classroom and/or Google Classroom).

The user acknowledges, and expressly accepts, that once the period for making the course content available has ended, in accordance with the provisions of the previous paragraph, the right of withdrawal will be lost.

How to exercise withdrawal:
 
To exercise the right of withdrawal, regardless of the type of course, the user must notify his/her decision to withdraw from the contract through the CDIUV's academic management software application ("Withdrawal" / "Request cancellation" option), with which he/she registered and paid for the course.

To meet the withdrawal deadline, it is sufficient to send notice regarding the exercise of withdrawal before the relevant period ends (in accordance with that indicated for each of the planned methods).

In the event of withdrawal, and with the exception provided for online courses that have already begun which is expressly accepted by the user, the Language Centre will refund all payments received within a maximum period of 14 calendar days from the date when it is informed of the user's decision to withdraw from the contract.

Any refund derived from the exercise of the right of withdrawal will be made using the same means of payment used by the user for the initial transaction. In any event, the user will not incur any costs as a result of a refund.

14. General Disclaimers 

Disclaimers:
 
The user's access to the Language Centre course website does not oblige the owner of the same to control the absence of viruses, worms or any other malicious software. 

In any event, the use of appropriate tools to detect and remove malicious computer programmes is the responsibility of the user.

The owner of the service shall not be held responsible for damages caused to the software or hardware of the computer equipment with which the user accesses the website.

The owner of the service shall not be held responsible for damages of any kind caused to the user that are the consequence of failures or disconnections in the telecommunications networks and that result in the suspension, cancellation or interruption of the service of the website during the provision of the same or previously.

Responsibilities regarding links and content of external resources:
 
The service of access to the website may include technical linking devices, directories and even search tools that allow the user to access other Internet pages and portals (hereinafter, linked sites). 

In these cases, the University of Valencia Language Centre will only be responsible for the content and services provided on the linked sites to the extent that it is effectively aware of any unlawfulness. In the event that the user considers that there is a site linked with illegal or inappropriate content, he/she may notify the University of Valencia Language Centre, although under no circumstances does this notice imply the obligation to remove the corresponding link.

Under no circumstances should the existence of linked sites presuppose the formalisation of agreements with the managers or owners thereof, nor the recommendation, promotion or identification of the University of Valencia Language Centre with the representations, contents or services provided by the owner thereof.

The University of Valencia Language Centre is unaware of content and services of the linked sites and, therefore, shall not be held responsible for damages caused by the unlawfulness, quality, outdated information, unavailability, error and uselessness of the content and/or services of the linked sites or for any other damages not directly attributable to it.

15. Intellectual and industrial property rights of the Language Centre course website 

All content on the website, including but not limited to texts, photographs, graphics, images, icons, technology, software, links and other audio-visual or audio content, as well as their graphic design and source codes, are intellectual property of the University of Valencia Language Centre, or of third parties. None of the exploitation rights recognised by the current legislation on intellectual property may be deemed to be transferred to the user.

Access to this website does not grant users the right or any ownership whatsoever of the intellectual property rights of the content of this website.

The trademarks, trade names or distinctive marks are the property of the Language Centre of the University of Valencia or of third parties, and it shall not be deemed that access to the website grants any rights regarding the same.

16. Use of the Language Centre course website 

By accessing and registering on the Language Centre course website, the user declares and guarantees that he/she is of sufficient legal age to enter into a binding contract, and that all the registration information submitted is accurate, truthful and up-to-date.

The user undertakes to use the Language Centre course website, and all its content and services, in accordance with the provisions of the law, the statutes of the University of Valencia Language Centre, morality, public order and these Terms of Use. Likewise, the user undertakes to make appropriate use of the services and/or content of the website and not to use them for illegal or criminal activities which violate the rights of third parties, and/or which violate current regulations on intellectual and industrial property, or any other applicable legal standards.

The University of Valencia Language Centre will not be liable for any possible claim, fine, penalty or sanction that may be imposed as a result of the user's failure to comply with any of the aforementioned rules of use, and the owner of the website reserves the right to seek appropriate compensation for any damages.

17. Nullity and ineffectiveness of clauses 

In the event that any provision or provisions of these general terms and conditions are considered null or unenforceable, in whole or in part, by any Court, Tribunal or competent administrative body, such nullity or unenforceability shall not affect the other provisions of the general terms and conditions or the particular terms and conditions of the different services of the UV Language Centre.

The non-exercise or execution by the UV Language Centre of any rights or provisions in these general terms and conditions shall not constitute a waiver thereof, unless acknowledged and agreed in writing by the UV Language Centre.

18. Applicable law and competent jurisdiction 

These Terms of Use shall be governed by or interpreted in accordance with Spanish legislation in all matters not expressly established. The owner of the website and the user may submit any dispute that may arise from the provision of the products or services covered by these Terms of Use to the courts and tribunals of the residence of the owner of the website unless legally established otherwise.
