In compliance with the provisions of Article 10 of Law 34/2002, of 11 July, on Information Society Services and E-commerce (hereinafter, LSSICE), general information on the services provided is offered on the courses website of the Centre d'Idiomes UV (CDIUV), an area of action managed by the FUNDACIÓ GENERAL DE LA UNIVERSITAT DE VALÈNCIA through the management assignment it receives from the University of Valencia

2. Purpose and scope of action
These Terms of Use, as well as the Specific Conditions of each course, regulates users' access and use of the CDIUV Courses website. By accepting these Terms of Use, the user declares:
- That he/she has read and understood the contents herein.
- That he/she is a person with enough capacity to purchase products or services.
- That he/she accepts all of the obligations stated herein.
The use of the CDIUV courses website and registration on it attributes the status of user of the website and implies acceptance of all the provisions included in these Terms of Use, which will be available to users at any time on the CDIUV Courses website. Consequently, the user declares to carefully read these Terms of Use.
The FGUV, through the CDIUV courses website, reserves the right to make any modification or update of the contents and services of these Terms of Use and, in general, of any of the elements that make up the design and configuration of the website, by means of communication to registered users. It will not affect the Specific Conditions of the courses already contracted, which will maintain the conditions in force at the time of contracting.
3. Access and registration
Access to the CDIUV courses website is free of charge, except for the cost of connecting the user to the telecommunications network via the access provider contracted by the user.
In general, user registration is not necessary in order to access the services and content of the website.
However, to enrol in a CDIUV course, registration is necessary and this implies prior acceptance of these Terms of Use, as well as the specific conditions of each course available before enrolling. The user will then receive an email to validate their identity and the registration will be completed successfully.
The registered user can access his/her private area with his/her email address and password in order to check and update his/her profile, enrol in courses, check his/her status or unsubscribe.
The data provided by the user will be processed by the FGUV in accordance with the provisions of the Privacy Policy available on the CDIUV courses website.
4. Users
The data entered by the user must be accurate, up-to-date and truthful at all times. Providing false data and in particular providing a false identity will be considered a violation of these Terms of Use and may result in the immediate blocking of the user's account and the claim of all damages that the inaccuracy of said data may have caused. Under no circumstances may the user register another person without proper authorisation.
The registered user will be responsible, at all times, for the custody of his/her password, consequently assuming any damage that may arise from its improper use, as well as from the assignment, disclosure or loss of it. For this purpose, access in the private area of the CDIUV courses website under the password of a registered user will be considered made by this registered user, who will be responsible in any case for this access and use.
By virtue of the above, it is the obligation of the user to immediately notify the FGUV of any fact that allows the improper use of the password, such as theft, loss, or unauthorized access to it, in order to proceed to its immediate cancellation.
If such issues are not reported, the FGUV shall not be held responsible for the misuse of usernames or passwords by unauthorized third parties.
5. Registration and enrolment process
To register and enrol in a course, the user will have to enter his/her private area and select the course he/she wishes to take. He/she will be able to consult the summary sheet and the course program, as well as its specific conditions.
The access of new students to non-beginner level groups is subject to the completion of a free level test, available on the CDIUV website, with the exception of the Valencian courses. This level test will not be necessary for students who can prove that they have a level certificate among those listed in the table of equivalences of language accreditation approved by the Governing Council of the Universitat de València: https://www.uv.es/sgeneral/Reglamentacio/Doc/Estudis/C81.pdf
"ENROL": once the course has been selected, the user will have to fill in the data requested on the next screen. Then, the user will need to read and accept the general conditions of the CDIUV courses, the specific conditions of the course, and the Privacy Policy in order to confirm their enrolment. Additionally, he/she may complete the billing information if the enrolment is on behalf of a company.
After completing the registration described above, the user will receive an email with the subject: 'Course Registration Confirmation.' To finalize the enrolment process, he/she must proceed with the course payment. Until the payment is made, the registration will not be completed and, therefore, there will be no place reservation.
Once the payment has been made, CDIUV will send an email to the user with the subject: 'Registration Successfully Completed,' including a link to the summary of the enrolled course. Once the payment has been made, the enrolment will be considered complete as a general rule.
In some courses there will be different prices depending on the group to which the student belongs. CDIUV will confirm the user's eligibility for the selected group by validating the documents submitted during enrolment and/or requesting additional documentation to verify membership in other groups.
Then, within the private area, the user will be able to check the status of the registration. Once the payment has been confirmed, the status will be 'Enrolled,' indicating the enrolment date and the option to exercise the right of withdrawal, a procedure described in sections 8 and 13 of these terms and conditions.
Waiting list: When a course is full and the waiting list is opened, users who wish to do so may sign up for it. If any places become available, it will be offered to the people on the waiting list in order of registration.
The user will receive an email with a link that will enable them to access the course application. The interested person will need to complete the registration through the usual procedure.
6. Course price and payment
The course price will be that which is indicated in the course description at the time of registration. In addition, special prices will be duly indicated in the course description.
Payment must be made by card as described in the previous point.
7. Cancellation of a course
The course will be held subject to the enrolment of the minimum number of students set for each course. If the number of students does not reach the minimum number established, the course may be cancelled. Likewise, it is at the discretion of the Management to divide or cancel a group based on the needs of the Centre. This situation will be communicated to the affected users, who will receive information about other available groups or, in any case, a full refund of the amounts paid.
The cancellation of a course entitles enrolled individuals to request a refund of the enrolment fee or to transfer to another course at the CDIUV of equal, lower, or higher cost (with the user or CDIUV covering the price difference) within the same academic year, provided that there are available spots and the requirements of the new course are met.
The reasons for cancellation are the following:
- Cancellation of a course for not reaching the minimum number of students
- Administrative error
- Due to supervening force majeure
- Change of schedule and/or dates by the teaching staff
8. Cancellation and withdrawals
Regardless of the right of withdrawal outlined in section 13 of these terms and conditions, a refund of the amounts paid for the enrolment fee can be requested according to the instructions set forth below, unless other terms are specified in the specific conditions document of the enrolled course. The request must be made by email to: contactocdi@uv.es
As a general rule, it is established:
If enrolment in the course is cancelled at least fifteen calendar days before the start date of the course and due to any of the following justified causes:
- change in the academic schedule at the UV that prevents attendance in class;
- starting a new job; change in work schedule;
- long-term illness; relocation to another city;
- denial of a visa; or any other force majeure cause, the user will be entitled to a full refund of the amounts paid, except for the enrolment fee, which is non-refundable under any circumstances. The reasons mentioned must be properly documented by the students.
If the enrolment in the course is cancelled with a minimum of fifteen calendar days' notice before the course start date for reasons not covered in section (a), the individual will be entitled to a 50% refund of the paid enrolment fee, except for the enrolment fee itself, which is non-refundable under any circumstances.
No refunds will be issued beyond the deadlines mentioned above. It is compulsory to process the course withdrawal and refund request through the course application or via email at contactocdi@uv.es. The cancellation or withdrawal request will be considered effective from the date of the sent email for the purpose of calculating deadlines that may entitle a refund of the amounts paid.
If the decision is favourable, the corresponding amount will be refunded.
9. Obtaining certificates
To obtain the certificate of attendance and/or completion of the course, the individual must be enrolled and must have met the minimum requirements specified in the course announcement.
Course certificates will be available to students who have passed the course within fifteen calendar days after the end of the course. In each course, students will be informed about how to obtain the certificate.
10. Virtual Classroom of the University of Valencia or Classroom and Intellectual Property of the Materials
Enrolment in CDIUV courses may involve the use of the Universitat de València's AULA VIRTUAL platform (AULA VIRTUAL UV), as well as any other applications specified in the Specific Conditions, for course management (access to materials and documents, forums, chats, email communication, calendar, etc.).
The materials made available to users are protected by copyright, and their reproduction and public communication have been carried out solely for educational purposes and for the individual use of the course students. Any reproduction, distribution, transformation and public communication in any medium and in any form, outside the said scope, is prohibited. Any failure to comply with the above will result in responsibilities for the person who violates it.
11. Confidentiality
All materials, videos, techniques, course mates' data, etc., shared with users are strictly confidential and provided solely for educational purposes. Therefore, they may not be used by individuals other than those specified or for purposes other than those stated, and their dissemination through any channel or public sharing is strictly prohibited.
On the other hand, it is prohibited to record classes, tutorials, video calls, etc., and/or broadcast them through any channel without the consent of all participants.
12. Specific course terms and conditions
The courses offered by the CDIUV have their specific conditions that will include, at least, the following:
- Introduction to the Area/Service: Technical Information of the Course: Program, Objectives, Methodology, Minimum Requirements
- Duration and location
- Price
- Mode: in-person/online, and which application will be used: UV Virtual Classroom.
- Image rights: whether the sessions will be recorded and for what purpose
- Contact: e-mail
- Access to General Course Terms and Conditions
- Access to Course Privacy Policy
13. Terms and Conditions of the right of withdrawal from
FACE-TO-FACE AND BLENDED COURSES:
Before the start of the course, and without the need to specify the reason, the user may exercise the right to withdraw from the contract within 14 calendar days from the date of enrolment, which is understood to be the date of the email confirmation that the enrolment has been successfully completed.
If the right of withdrawal is exercised after the course has started, but within the 14 calendar days from the date of enrolment, the amount paid will be refunded, minus the proportional amount corresponding to the part of the course attended from its start until the date of the withdrawal notice.
ONLINE COURSES:
In online courses, the user may exercise the right of withdrawal within 14 calendar days from the date of enrolment, provided that the course has not yet started, in accordance with the exception contained in Article 103.m of the General Law for the Defence of Consumers and Users (LGDCU).
The course execution begins on the scheduled date for accessing the course content available through the application used for each course (Virtual Classroom of the Universitat de València).
Therefore, the user is aware and expressly agrees that once the period for accessing the course content has passed, as outlined in the previous paragraph, their right to withdrawal is forfeited.
How to withdraw
To exercise the right of withdrawal, regardless of the course mode, the user must notify their decision to withdraw from the contract through the academic management application (option 'Make Withdrawal' / 'Request Withdrawal') with which he/she enrolled and made the payment for the course.
To meet the withdrawal deadline, it is sufficient to send the cancellation notice before the deadline expires, as specified for each course modality.
In case of withdrawal, and with the exception provided for online courses that have already started, which is expressly accepted by the user, the FGUV will refund all payments received within a maximum of 14 calendar days from the date it is informed of the user's decision to withdraw from the contract.
Any refund derived from the exercise of the right of withdrawal will be made using the same means of payment used by the user for the initial transaction. In no case will the user incur any costs as a result of the refund.
14. Exclusion of liability
General exclusions:
Accessing the CDIUV courses website does not imply any obligation on the part of the owner to control the absence of viruses, worms, or any other harmful computer elements.
It is the user’s responsibility in all cases to have the appropriate tools for the detection and removal of harmful computer software.
The service owner is not responsible for any damage caused to the software or hardware of the computer equipment with which the user accesses the website.
The service owner is not responsible for damages of any kind caused to the user, nor for the events that are a consequence of failures or disconnections in the telecommunications networks and that cause the suspension, cancellation or interruption of the service of the website during the provision of the same or in advance.
Responsibilities for external resource links and content:
The service of access to the website may include technical links, directories and even search tools that allow the user to access other pages and internet portals (hereinafter referred to as linked sites).
In these cases, the FGUV will only be responsible for the content and services provided on the linked sites to the extent that it has actual knowledge of their illegality. In the event that the user considers that there is a place linked to illegal or inappropriate content, he/she may notify the FGUV, without in any case this communication entailing the obligation to remove the corresponding link.
Under no circumstance does the existence of linked sites have to presuppose the formalisation of agreements with the managers or owners thereof, nor the recommendation, promotion or identification of the FGUV with the statements, contents or services provided by the holder thereof.
The FGUV does not know the contents and services of the linked places and, therefore, is not responsible for the damages caused by the unlawfulness, quality, outdatedness, unavailability, error and uselessness of the contents and/or services of the linked places or for any other evil that is not directly attributable to it.
15. Intellectual and industrial property rights of the Language Centre course website
All content on the website, including but not limited to texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or audio content, as well as its graphic design and source code, are the intellectual property of the FGUV or third parties, and none of the exploitation rights recognized by current intellectual property laws are transferred to the user.
Access to the website does not grant users the right or any ownership whatsoever of the intellectual property rights of the content of this website.
The trademarks, trade names or distinctive signs are the property of the FGUV or third parties, without it being understood that access to the website attributes any right to them.
16. Use of the Language Centre course website
The user, by accessing and registering on the CDIUV courses website, declares and guarantees that he/she is of sufficient legal age to enter into a binding contract, and that all the registration information presented is accurate, truthful and up-to-date.
The user agrees to use the CDIUV courses website, along with all its content and services, in accordance with the law, the FGUV's statutes, morals, public order, and these Terms of Use. Furthermore, the user agrees to make appropriate use of the website’s services and/or content, and not to use them for illegal activities or those constituting a crime, that infringe the rights of third parties and/or violate current intellectual and industrial property laws, or any other applicable legal regulations.
The FGUV will not be liable for any possible claim, fine, penalty or sanction that it may be forced to bear as a result of the user's breach of any of the rules of use indicated above, and the owner of the website also reserves the right to request the corresponding compensation for damages.
17. Nullity and ineffectiveness of clauses
In the event that any provision or provisions of these general terms and conditions are considered null or unenforceable, in whole or in part, by any competent court, tribunal, or administrative body, such nullity or unenforceability will not affect the other provisions of the general terms and conditions or the specific conditions of the different services of the FGUV.
The failure of the FGUV to exercise or enforce any right or provision contained in these general terms and conditions will not constitute a waiver of that right, unless it is acknowledged and agreed to in writing by the FGUV.
18. Applicable law and competent jurisdiction
Anything not specifically covered in these General Terms and Conditions will be governed and interpreted in accordance with Spanish legislation. The owner of the website and the user may submit any disputes arising from the provision of the products or services covered by these Terms of Use to the courts and tribunals of the owner's place of residence, unless otherwise legally established.
