The UV research groups (GIUV) are regulated in the 1st chapter of the Regulation ACGUV48/2013, which explains the procedure for creating new research structures. They are basic research and organizational structures that result from the voluntary association of researchers that share objectives, facilities, resources and common lines of research. These researchers are also committed to the consolidation and stability of their activity, work in groups and the capability to achieve a sustainable funding.

The research groups included in the previously mentioned Regulation are registered in the Register of Research Structures of the Universitat de València (REIUV), managed by the Office of the Vice-principal for Research. The basic information of these organisms can be found in this website.

Description of research activity:
Individual and Family rights are two strongly connected areas of the legal system, which are undergoing an increasing evolution in modern societies, with great repercussions for people's daily lives and the free development of their personalities. The importance of the subjects, that form the object of these disciplines and their continuous transformations, justify the existence of a Research Group aimed at studying them and transferring the results of the research carried out to society. The members of the Group have been involved in individual and family rights for many years, both individually and as a cohesive group. They are currently participating in the following research projects (of which the lead researcher is the head of the Group) "La modernización del derecho de familia a través de la práctica jurisprudencial" (AICO/2021/0900), Generalidad Valenciana; y "Adaptation of rights in rem in cross-border successions within EU" (101007501 EU-ADAPT), JUST-JCOO-AG-2020.

  • Estudio de las transformaciones y de los principales problemas juridicos que actualmente plantean el Derecho de la Persona y el Derecho de Familia
 
Research lines:
  • Family; minors; honour; alimony.Study of the transformations and main legal issues currently faced by Law of Persons and Family Law.
  • Attribution of the use of the family home.Analysis of the attribution of the use of the family home that takes place when a family crisis occurs, evaluating the current sociological circumstances in order to suggest solutions de lege ferenda.
  • The maintenance obligation.Study of the cases in which the legal obligation of parents to provide maintenance for their children who are economically dependent for reasons not attributable to them is applicable and, where appropriate, the amount and scope of such obligation.
  • Visiting rights.Study of the cases, in which it's appropriate and, where applicable, the extension of, the visiting rights of parents with their minor children that are granted after a family crisis.
  • Disability Law.Study of the new Disability law incorporated into the Spanish legal system by Law 8/2021, of June 2, which reforms civil and procedural legislation to support people with disabilities in the exercise of their legal capacity.
