Description of research activity:

INTERGENDIG is an interdisciplinary group with an international and social focus and vocation, whose objective is to promote research with a gender perspective in the fields of private international law, labour law, commercial law, philosophy of law and psychology. Hence, the Group is made up of professionals from all these disciplines. All of these disciplines will also address the phenomenon of migration and the role of digitalisation as a tool for promoting gender equality and the advancement of knowledge in this context.

Scientific-technical goals:
  • Analizar el fenómeno de las migraciones desde las disciplinas antes mencionadas y con perspectiva de género.
  • Promover la investigación con perspectiva de género en el ámbito del Derecho internacional privado, el derecho laboral, el derecho mercantil, el derecho internacional público, la filosofía del derecho y la psicología. De ahí que el Grupo esté integrado por profesionales de todas estas disciplinas. Con ellas se abordarán también otras muchas disciplinas en las que la perspectiva de género es fundamental.
  • Analizar el impacto de la digitalización como herramienta para fomentar la igualdad de género y el progreso del conocimiento en este contexto. El reforzamiento de la cooperación judicial digitalizada puede permitir avanzar en la lucha contra las discriminaciones y es fundamental examinar la evolución de la misma y sus posibilidades en este contexto, dadas las diferencias existentes todavía hoy entre los Estados.
 
Research lines:
  • Gender, fundamental rights, human rights and feminist private international law in transnational contexts..This approach addresses the need to protect human rights using the techniques and instruments of private international law. Such protection is achieved through the introduction of a feminist methodology into the discipline, which is essential for the advancement of transnational justice that progressively incorporates a gender perspective both cross-cutting and international into the interpretation and application of the law
  • International migration, gender-based violence, and the protection of vulnerable persons.This line of inquiry addresses the phenomenon of migration and interculturalism, which gives rise to complex problems faced by national judges. These include issues arising from disparities in certain legal systems that conflict with those of the forum, and, consequently, the practical role of public policy. Also of concern is the rise in cases of gender-based violence against foreign women in Spain, despite existing legislation on nationality and immigration - as an aspect of private international law - which seeks to protect them through ongoing measures.
  • Digital transformations, international judicial cooperation and access to justice with a gender perspective.This section focuses on analysing the digitisation of judicial cooperation, for the time being within the EU, in light of the technological challenges involved in digitising the justice system and judicial proceedings. It appears that the recast of Regulation (EU) 2020/1783 (service of documents) and Regulation (EU) 2020/1784 (evidence) may represent a step towards making digital means of communication mandatory and their use in the fight for transnational feminist justice. The role in this area of Regulation (EU) 2023/2844 on the digitalisation of judicial cooperation and other possible tools will also be analysed.
  • International family law with a gender focus: surrogacy, international abductions, protection of minors and protection of vulnerable adults..The need for a gender perspective in private international law is particularly evident in various aspects of international family law and the way in which women¿s rights are addressed within them. Particularly complex is the analysis of international child abduction by mothers who are victims of violence, the commodification of women in cases of surrogacy and, in general, all litigation in which the rights of women, as well as those of minors and vulnerable adults, may be involved.
  • International labour and business law from a gender perspective..This line of research explores various areas of labour and business law - at European, international and national levels - where a gender-based analysis is urgently needed, given the potential infringement of the rights of vulnerable groups, such as workers and consumers, among others, who find themselves in vulnerable situations for a variety of reasons
  • Methodology of behavioural sciences in the context of vulnerable groups and the implementation of gender equality policies..This line of research focuses on the study of the cross-cultural adaptation and equivalence of instruments required for the assessment of disputes that may arise from private international relations. Hence the need to examine issues such as gender-based violence and the urgent need to implement policies promoting equality and the protection of vulnerable groups.
