Sebastián I. Sánchez Cannavó

A former student of the University Master’s Degree in Law, Business and Justice, Sebastián I. Sánchez Cannavó, launched his first book under the title ‘Crédito al Consumo’. This work has been published by Ediciones DyD from Buenos Aires, Argentine Republic.

The work was based on his Master’s Degree Final Project under the title ‘Responsibility of the credit grantor for the over-indebtedness of the consumer in Argentine law’, carried out in 2016 and directed by the Professor Dr. Jesús Olavarría Iglesia.

The credit took a fundamental role, because for large sectors of the population was the way to access to enjoy a series of goods and services to improve their standard of living.

The study was motivated by the relevance of the consumption financing, not only for the consumers but also for the development of  the Industry and Commerce and the economic capitalist performance -basically credit-. He took into account the particular situation of Argentina, where in recent years consumption was promoted and stimulated as a way to increase economic activity. And in this context, credit played a fundamental role, since for large sectors of the population it was the way to access to enjoy a series of goods and services to improve their standard of living (eg, purchase of household appliances, clothing, cars, tourism, housing arrangements, etc.) and those who otherwise would not have access to it. So the problem of financing for consumption is a very topical issue.

The investigation focused on the phenomenon of over-indebtedness. This is the situation of the consumer who has incurred expenses and incurred domestic debts -or non-professional or business- above their ability to pay. The behavior deployed by financial institutions and suppliers of goods and services is an unavoidable element - although not the only one - in generating the problem of over-indebtedness. Deceptive advertising, aggressive promotions, financing without adequate verification of the consumer's payment possibilities and poor information on credit conditions are determinant in this regard. These are probably the most usual causes of excessive consumer indebtedness.

The author thanked the Director of Labor, Professor Jesús Olavarría Iglesia, for his guidance and contributions -both in Valencia, and then from a distance- were fundamental for the delimitation of the theme and development of the study. He has also made recognition to the Director of the Master, Professor Carlos Esplugues Mota, as well as all the teachers of the course and their classmates.
