FOR BIRTHS OCCURRING ON OR AFTER JULY 31, 2025:
The maximum leave period is 19 weeks. For single-parent families, it is 32 weeks. The leave may be taken as follows:
- The first 6 weeks constitute a mandatory, uninterrupted, full-time leave period (starting from the date of birth).
- The following 11 weeks may be taken consecutively or in separate weekly periods, up until the child turns 12 months old. For single-parent families, this period is 22 weeks.
Part-time leave is permitted only if service requirements allow.
- The final 2 weeks may be taken in weekly periods—either consecutively or separately—up until the child turns 8 years old. For single-parent families, this period is 4 weeks.
Part-time leave is permitted only if service requirements allow.

FOR BIRTHS OCCURRING BETWEEN AUGUST 2, 2024, AND JULY 30, 2025:
Due to legislative changes introduced by Royal Decree-Law 9/2025 of July 29, the eligible individual has the right to request an additional 2-week period of paid leave.
For single-parent families, the additional leave period is 4 weeks.
These additional weeks may ONLY be taken in weekly periods—either consecutively to the previous leave or separately—up until the child turns 8 years old.
Part-time leave is permitted only if service requirements allow.
EXTENSIONS APPLICABLE TO ALL PERIODS:
- The leave for birth and child care is extended by 2 additional weeks (1 for each parent) for each child starting from the second child.
- The leave for birth and child care is extended by one additional week (for each parent) in the event of the child's disability. - Leave for the birth and care of a child is extended to up to 13 weeks in the event of the newborn's hospitalization.
