Posted workers

A posted worker is one who is sent by his company to another country to perform a specific job for a limited time or who carries out his work activities temporarily in a country other than his usual residence, always under the direction of a company established in his country of origin

Data communication to the Social Security Division
If you are Teaching and Research Staff (PDI), Research Staff (PI) or Technical Staff, Management and Administration and Services (PTGAS) and you will carry out research or teaching, carry out a stay, or carry out your duties in a foreign country and you are linked to work or administration with the University of Valencia, you must communicate the teu Displacement to the Social Security Section.

COMMUNICATION OF DATA TO THE SOCIAL SECURITY SECTION

 

To be able to formalize your Travel with the General Treasury of Social Security (TGSS), you must fill out the 

DISPLACEMENT_DATA_TABLE


and send it filled out to the email address(seccionss@uv.es).

It is also advisable to send, 'together with the displacement form,' the confirmation/authorization of it from your department, center, service, or unit.

ALWAYS PRIOR TO THE START DATE OF THE TRIP AND REGARDLESS OF ITS DURATION.

 

PROCESSING THROUGH THE SOCIAL SECURITY SECTION:

The Social Security Section, as the representative of the seconded worker, will submit the request for the A1 or TA.300 form, depending on the foreign country to which the staff from the University of Valencia is sent:


- The A1 document for workers posted to European Union Member States, the European Economic Area, Switzerland, the United Kingdom, and Gibraltar.

- The TA300 document for the rest of the foreign countries with which there is an agreement with the Spanish Social Security.

Once the application has been processed by the Social Security Section before the relevant Provincial Directorate or Administration of the General Treasury of Social Security, this body issues a resolution certifying that the worker continues to be subject to Spanish Social Security legislation during their stay in that country, and consequently is exempt from paying into the Social Security system of the destination country.

"At that moment, the Social Security Section will get in touch with the worker, who will travel to receive this resolution along with some necessary instructions to ensure healthcare during their trip."

 

HEALTH INFORMATION FOR THE MOBILE WORKER:

The Social Security Section of the University of Valencia will send you the following information by email, depending on the destination of your trip:

 

  • Travel to EU Member States, EEA, Switzerland, the United Kingdom, and Gibraltar:

For temporary healthcare, the displaced worker will need to apply for the European Health Insurance Card through the following link:

If the posted worker will be living in the host country, they will need to request the S1 Document in Spain and present it in the country where they will be living to access healthcare.

This document certifies the right to receive healthcare covered by Spain in cases of habitual residence in another country of the European Union, Iceland, Liechtenstein, Norway, Switzerland, or the United Kingdom.

You can request it at the following link on the  Social Security benefits portal (they will ask that you have previously obtained the A1 document or the corresponding agreement issued by the General Treasury of Social Security).

  • Trips to the other foreign countries where there is an agreement with the Spanish Social Security:

It is recommended that you take out a private health insurance policy.

 

RIGHTS AND OBLIGATIONS OF A DISPLACED WORKER:

During their stay abroad, every posted worker has a series of rights and obligations that need to be taken into account.

As for rights, they would mainly include the right to healthcare, for example, through the European Health Insurance Card or the S1 document; the option to choose the applicable social security scheme, in this case, that of their country of origin; and access to certain benefits such as temporary disability or work accident benefits.

However, among the obligations is to inform the University of Valencia of any changes in your work situation, as well as to comply with the regulations of the destination country regarding your work activity.

DATA COMMUNICATION TO THE SOCIAL SECURITY SECTION

To be able to formalize your Transfer with the General Treasury of Social Security (TGSS), you will need to fill out the DISPLACEMENT_DATA_TABLE and send it completed to the email address (seccionss@uv.es) .

It's also convenient that the confirmation/authorization of it by your department, center, service, or unit be sent along with the displacement chart.

ALWAYS BEFORE THE START DATE OF THE TRIP AND REGARDLESS OF ITS DURATION.

The Social Security Section, as the representative of the displaced worker, will carry out the request for the A1 or TA.300 form, depending on the foreign country to which the staff from the University of Valencia is moving:

-The A1 document for workers posted to member states of the European Union, European Economic Area, Switzerland, the United Kingdom, and Gibraltar.

- The TA300 document for the rest of the foreign countries that have an agreement with the Spanish Social Security.

Once the application has been processed by the Social Security Section before the corresponding Provincial Directorate or Administration of the General Treasury of Social Security, this body issues a resolution certifying that the worker remains subject to Spanish Social Security legislation during their stay in that country, and consequently is exempt from contributing to the Social Security of the destination country.

At that moment, the Social Security Section will get in touch with the worker who is going to be relocated to send them that resolution.

 

HEALTH INFORMATION FOR THE DISPLACED WORKER:

Newly hired civil servants (appointments from 01/01/2011), who are subject to the social security system for retirement and other collection concepts, however, for healthcare and other benefits, are members of M.U.F.A.C.E.

However, please note that there is NO DIRECT health coverage from M.U.F.A.C.E. outside the country; so any medical expenses you pay while abroad will be reimbursed by M.U.F.A.C.E., up to the financial limits set by this organization. You should keep all medical reports, invoices, and any documents that may help you request reimbursement for these expenses.

On the other hand, if the destination Center asks you for a CERTIFICATE regarding your status as a contributor to M.U.F.A.C.E., you can request it from this organization:

•        In person at the address: M.U.F.A.C.E. C/ Arquitecto Mora nº1. 46010 VALENCIA Phone 963.07.30.00, attaching a copy of the UV license or authorization for the stay for work reasons.

•        Electronically, through the Documents and Certificates section - Coverage for assistance abroad, on the following M.U.F.A.C.E. website link: https://sede.muface.gob.es

State Passive Class System staff + MUFACE (PDI – Teaching and Research staff OFFICIAL whose appointment was earlier to 01/01/2011)

You should NOT report the movement to the Social Security Section but to the HR Service for PDI.

 

Please note that there is NO DIRECT health coverage from M.U.F.A.C.E. outside the national territory; therefore, any medical expenses you may pay during your stay abroad will be reimbursed by M.U.F.A.C.E., within the financial limits established by this organization. You should keep all medical reports, invoices, and documentation that may help you when requesting reimbursement of expenses.

Applicable regulations to posted workers

The administrative situation of a Posted Worker is mainly regulated through Social Security regulations and the labor legislation of each country.

Based on this regulation and in accordance with Article 12.1 of Regulation (EC) No. 883/2004 of the European Parliament and of the Council of 29 April 2004 on the coordination of social security systems, a Posted Worker will continue to be subject to the social security rules of their home country, as long as the duration of their posting does not exceed twenty-four months and they have not been sent to replace another previously posted worker.
